YOUR CONSUMER RIGHT OF RETURN AND REFUND 2018
If you are a consumer, you have a legal right to cancel a contract to purchase goods under the Consumer regulations 2013 as detailed below. This means that during the relevant period if you change your mind or decide for any other reason that you do not want to receive or keep a Product, you can notify us of your decision to cancel the Contract and receive a refund. Advice about your legal right to cancel the Contract is available from your local Citizens’ Advice Bureau or Trading Standards office.
However, this right of cancellation right does not apply to any product that has had a surface finish applied to it as part of your order specification and direction (for example, primer finish, painting or powder coating). Our work in the provision of these services and the additional products used as part of these services cannot be cancelled once the order is received and this work has been undertaken (as permitted by law) and due to the labour intensive nature of the additional works involved in restoring the products following a full surface finish, we will only be obliged to refund 60% of the price you paid for the product excluding the full cost of the surface finish.
AEL shall use all reasonable endeavours to meet any delivery dates discussed but any such dates shall be estimates only and time shall not be of the essence for the performance of the service or reason to cancel an order. You the consumer will be informed should an unforeseen delay occur.
Your legal right to cancel a contracted order starts from the date we receive your order which is when the instruction to proceed is confirmed. Your deadline for cancelling the order then depends on what you have ordered and how it is delivered, as explained below:
To cancel a contracted order, you just need to let us know in writing that you have decided to cancel. The easiest way to do this is to send an e mail to sales@aelheating.com . If you use this method we will email you by return to confirm that we have received your cancellation. If you are emailing us then please include details of your order to help us to identify it and your detailed reason for cancellation. If you send us your cancellation notice by email, then your cancellation is effective from the date you send us the email.
If you cancel your order contract we may :
1. Refund you the price you paid for the products, but not the cost of the surface finish applied to the product as per your instruction or specification and in which case due to the additional works involved in restoring the products following a full surface finish, we will only be obliged to refund 60% of the price you paid for the product unless they have been installed or damage has been caused by your handling of them in a way which we deemed poor practice or in a unreasonable manner as we are permitted by law to do so.
If you have returned the Products to us and we agree that they are faulty through manufacturing defects we will replace the goods as a priority .
If a product has been delivered to you before you decide to cancel your contract of sale then you must return it to us without delay and no later than 7 days after the day on which you let us know that you wish to cancel the contract. The goods will be inspected once received back into our Runcorn warehouse and a report provided, any part of the goods that are damaged shall be fully chargeable to you the consumer.
Because you are a consumer, we are under a legal duty to supply products that are in conformity with the contract of sale. As a consumer, you have legal rights in relation to products that are faulty or not as described in our literature. These legal rights are not affected by your right of return and refund or anything else in these terms.
